Terms of use and conditions of sale

These terms of use and conditions of sale (hereinafter "Terms and Conditions") govern the use of the Site by users and the distance sale of products marketed on this, governed by Chapter I, Title III (art. 45 et seq.) of the Legislative Decree 6 September 2005, n. 206 ("Consumer Code"), when it involves a Consumer, and by the Legislative Decree 9 April 2003, n. 70, containing the discipline of electronic commerce.

The Seller undertakes to make these documents always accessible and up-to-date, and reserves the right to modify them at any time, effective from the date of publication on the Site.
DEFINITIONS
For the purposes of these Terms and Conditions, means:
"Contract": the contract for the distance sale of products marketed by the Site, between CARBONWORLD ITALIA and an end customer, within the framework of a distance selling system that uses the Internet as a remote communication technology.
"Customer ": (i) the Consumer pursuant to art. 3, paragraph I, lett. a) the Consumer Code, as a natural person who makes a purchase on the Site for purposes unrelated to the business, commercial, craft or professional activity carried out by the same; (ii) the professional pursuant to art. 3, paragraph I, lett. c) as a natural or legal person who makes a purchase on the Site in the exercise of their business, commercial, craft or professional activity, or an intermediary thereof
"User": the one who accesses the Site and continues his navigation.
"Shopping cart": final stage of the purchase process in which the User sends his purchase proposal by selecting the payment method, shipping and other options.
"Order": the purchase proposal that the user sends to CARBONWORLD ITALIA, completing the order procedure described.
Subject
With this Agreement, CARBONWORLD ITALIA sells and the Customer buys at a distance, through telematic means, the products indicated and offered for sale on the Site.
These Terms and Conditions do not regulate the sale of products or the provision of services carried out by third parties that use direct links to the Site through banners or other hypertext links/links. On the websites consulted through these links, CARBONWORLD ITALIA does not carry out any type of control/ monitoring. Therefore, in no case CARBONWORLD ITALIA can be held responsible for the goods or services promised by third parties or for the execution of transactions between the Users of the Site and third parties.
SERVICE AVAILABILITY AND TERMS OF USE
The sale of products on the Site may be temporarily suspended without prior notice, for the time strictly necessary to carry out the technical measures required and/or appropriate on the platform, or where there are justified security reasons or breaches of confidentiality. CARBONWORLD ITALIA reserves the right, in any case, not to accept orders from anyone who comes, which are abnormal in relation to the quantity or frequency of purchases made on the site.
CARBONWORLD ITALIA reserves the right not to accept orders from a) users with whom legal disputes are ongoing; b) users involved in credit card fraud; c) users who have provided identification data which is then found to be false, incomplete or inaccurate.
By using this website and/or placing orders through it, you agree to: 1. use the website solely for lawful activities; 2. not to place false or fraudulent orders. If there are reasonable grounds for believing that orders of this nature are being placed, the Seller reserves the right to cancel the order and inform the competent authorities.
PRODUCTS FOR SALE
The products offered for sale through this Site are products for motorcycles, specifically stickers, stickers, fairings and similar products and are described in the relevant information sheet that explains the main characteristics and materials of composition.
The images and descriptions included in the Product Sheet are for illustrative and demonstrative purposes and, despite efforts to describe and represent them as realistically as possible, may not be perfectly representative of the real products that consist of products of artisanal production, and therefore may differ slightly in shape, color (also due to the different colors of the screens of the devices used) or have "small imperfections" due to hand-work. We guarantee our effort to represent the products in the most truthful way and corresponding to reality.
These General Conditions of Sale do not include the assembly, installation and application of the Products , which are not subject to this Agreement and therefore are excluded. Therefore, CARBONWORLD ITALIA is excluded from liability for damages reported on the products by the Customer in these stages.
USE OF OTHER MARKS FOR DESCRIPTIVE AND COMPATIBILITY PURPOSES
The Customer is informed that, except in cases where the products are indicated as "original" or "official", by which it means that the products are manufactured, marked and placed on the market by its parent company (e.g. Ducati, BMW), in all other cases it is CARBONWORLD ITALIA products, and the brands and models shown on the Site are used only to indicate the destination of CARBONWORLD ITALIA products, as accessories or spare parts. The use of other brands, therefore, has only a descriptive purpose of the compatibility of products with said brands and their models (art. 21 Industrial Property Code).
Between CARBONWORLD ITALIA and the brands listed on the Site there is no commercial link, nor is CARBONWORLD ITALIA the licensee of the respective brands.
AVAILABILITY OF PRODUCTS
All orders of products are subject to availability. The availability of products refers to the moment when the Customer consults the Product Sheets and should be considered indicative as the Site can be visited by several Users at the same time, and it could happen that, at the same time, more Users place the order for the same product. Therefore, it may happen that the computer system of the Site marks as available a product that is not actually available, as sold to others before the confirmation of the order. In such cases, the Seller cannot be held responsible for the unavailability of one or more products. CARBONWORLD ITALIA cannot be held responsible for the temporary or permanent unavailability of one or more products. If the order has been transmitted and the price already charged for the items that are no longer available, the Seller will refund to the Customer the entire amount paid for those items. In case of unavailability, partial or total of the goods, also following the sending of the Order Confirmation email, the Customer will be informed promptly by e-mail. In this case, the purchase contract will be considered terminated and CARBONWORLD ITALIA will provide a refund of the price and shipping costs (where applicable and, in the case where the purchase has concerned only the Product not available or, in the case of multiple orders, limited to the shipping costs specifically related to the Product not available). In the case of multiple orders, the unavailability of one or more of the ordered products will not give the Customer the right to cancel the entire order.
Products not in stock (not physically present in stock) may take between 3 and 10 weeks to arrive, depending on the type of product. Therefore CARBONWORLD ITALIA is committed to accelerate the production process and the subsequent shipment of the product.
Registration
To place orders through this Site you must first register by creating an account, by filling out the registration form, where the user will enter the personal data required, also to store the way in which the User makes use of the Services of the Site (e.g. payment, delivery etc.).
The User who registers is responsible for the veracity, correctness and updating of the data entered, guarantees to be the legitimate owner and undertakes to comply with the applicable legal regulations and the Terms and Conditions of the Site. All data transmitted will be processed in compliance with the privacy policy for the sole purpose of executing orders and, only with the consent of users, to promote products or promotions on the Site.
PURCHASING PROCEDURE
After creating the account and logging in with the relevant credentials, the User can purchase the products offered for sale on the Site by completing the order transmission procedure and the instructions contained therein available in the Italian language only. In cases of customized products, the User will be asked to fill out other sections in which specify the requested customizations. Before sending the order to the User, the order summary will be shown in the Cart containing the selected products, the price of the products, including taxes, shipping costs and other additional costs (if applicable). The User will then be able to identify and correct any errors that may have occurred during the filling in of the fields, as well as to review these Terms and Conditions, a summary of the time and costs of shipping and the Privacy Policy. To submit the order, the User must click on the button to complete the order and proceed with the payment in the chosen way.
By placing an order, the Customer declares that he has read all the information provided to him during the purchase process, and accepts these Terms and Conditions in full, and expressly acknowledges and accepts that this implies the obligation to pay the price and other amounts due under these Terms and Conditions and that the order cannot be modified or cancelled after its dispatch.
CONCLUSION OF THE CONTRACT
The Contract between Seller and Customer shall be deemed concluded only with the acceptance of the order by the Seller through the sending of an email confirming the order, which is equivalent to the acceptance of the purchase proposal. Only the products indicated in the order confirmation will be the subject of the contract. In case of payment by bank transfer, the Contract shall be deemed concluded only with the receipt of the bank credit on the account of CARBONWORLD ITALIA. Therefore, from that moment on you will have to calculate the delivery time.
The Seller reserves the right, at its discretion, to refuse the order, even in cases where: a) the order cannot be executed due to: error in the information provided by the User when placing the order (e.g. payment card; Expiry date etc. ); Incorrect billing address; insufficient or incorrect shipping address; Misleading information; The product cannot be delivered to certain disadvantaged geographical areas; b) there is an error on the Site regarding the price, product description or its availability of the product. In such cases, the Seller will proceed to cancel the order and refund what has already been paid by the User for the payment of the products.
The purchase contract will be considered terminated in case of non-payment, even partial, of the price of the product, shipping costs, if provided for, and any other additional cost as a result of the order . In the event that the Total Amount Due is not paid or the successful outcome of the payment is not confirmed, the purchase contract shall be considered to have been terminated by law pursuant to and for the purposes of art. 1456 c.c. Of such termination and subsequent cancellation of the order, the Customer will be promptly notified.
Payment
The payment methods available on the Site are as described below.
Credit cards
Credit and debit cards are accepted: American Express, Mastercard, Visa.
If, for any reason, it is not possible to charge the amount due, the sale process will be automatically canceled and the sale will be resolved as per art. 1456 c.c. The Customer will be informed by e-mail. The charge will be made at the time of transmission of the order. For security purposes, you may be required to authenticate via mobile devices or other means required by the Payment Services. Failure to complete the above procedure may mean that it is not possible to finalize the purchase on the Site.
PayPal
Paypal payments are also accepted through the following channels: MasterCard, Visa, Visa Electron, Maestro, American Express, Discover and Aurora.
If you choose this payment method, you will be redirected to the PayPal site where you will pay according to the procedure provided for and regulated there, which may also require a multi-factor security procedure such as sending confirmation emails. PayPal uses the latest and most up-to-date SSL security protocols and data encryption. In case of cancellation of the order or in other cases where it is necessary to proceed with the reimbursement of the expenses incurred by the Customer, the corresponding amounts will be refunded through the PayPal account, unless otherwise agreed with CARBONWORLD ITALIA.
PRICES
The sales prices displayed on the Site are in Euro and excluding I.V.A. tax.
The price applied to the contractual relationship between Seller and Customer will be that in force at the time of the order and indicated in the order confirmation, without considering increases or decreases in price, even for promotions, possibly occurred later.
DUTIES, TAXES AND OTHER TAX CHARGES FOR EXTRA-EU CUSTOMERS
In the case of purchase by a customer from outside Europe, please note that the price will be shown without VAT and duties, taxes and other tax charges may apply as required by the country of import. It is not possible to predict in any way whether and what costs would be incurred for the clearance of goods. The payment of these is to be borne by the Customer.

CARBONWORLD ITALIA does not accept requests for false declarations on the value of goods purchased and shipped to non-EU countries.
Invoicing
Upon request of the Customer to be made at the same time as the order, CARBONWORLD ITALIA will issue the invoice, using the information provided by the Customer and that the latter guarantees to be true, and will send it via e-mail to the Customer. After the invoice has been issued, it will not be possible to make any changes to the data indicated in the invoice.
ATTENTION: Invoice requests will not be accepted after the order has been sent. In case of non-receipt of invoice, the order will be entered into our electronic payment register that we send regularly to the Revenue Agency and which cannot be modified later.
SHIPPING AND DELIVERY OF PRODUCTS
The shipment is entrusted to national and international carriers who normally carry it out from Monday to Friday, excluding public holidays.
DELIVERY RESTRICTIONS
Warning: We do not ship to Russia and Ukraine.
Shipping Restrictions and Delivery Times
No shipments are allowed to P.O. boxes or automatic package distribution points. Orders are shipped via courier, and a physical person's presence is required for signature upon delivery of the package.
DELIVERY TIMES Delivery times for Italy and Europe can vary from a minimum of 5 to a maximum of 18 working days. Delivery times for non-EU countries may vary depending on the destination country.
Please note:
- Products available in stock will be entrusted to the courier approximately within 2-5 working days from order receipt (timing may vary during peak seasons or holidays).
- Products out of stock require longer processing times, generally ranging from 3 to 10 weeks, depending on the product type.
SHIPPING COSTS Shipping costs vary depending on the delivery address and the volumetric weight of the purchased products. In case the recipient is unavailable at the indicated address, the courier will contact the recipient by phone or email and will attempt to deliver again on subsequent days. If delivery cannot be made in the following days due to the recipient’s absence, the ordered products will be held at the relevant branch, accruing storage fees charged to the customer. After the storage period without successful delivery, the products will be returned to the Seller, and the order will be canceled under Article 1456 of the Italian Civil Code, without prejudice to the right to compensation for damages arising from transportation and storage costs, which CARBONWORLD ITALIA reserves the right to deduct from the refund.
The risk of loss or damage to the products, not attributable to the Seller, is transferred to the customer when the customer or a third party designated by the customer (other than the carrier) physically takes possession of the product.
ATTENTION UPON DELIVERY As the products may be susceptible to breakage or damage during transport, before accepting the package, please ensure:
- That the number of packages delivered matches the number indicated on the transport document.
- That the packaging is intact and not altered, including the closing materials.
- That the package is delivered carefully and diligently by the courier.
- To sign with a "reservation of specific control" in case of anomalies, damaged, or altered packages, as explained further.
- To check the integrity of the contents within 24 hours of delivery.
- To photograph the item from multiple perspectives as received from the courier.
RIGHT OF WITHDRAWAL The Consumer Customer is entitled to the right of withdrawal, meaning the right to return the goods and receive a refund of the amount paid. The right of withdrawal is excluded in the case of:
- Purchases by customers acting as professionals according to Article 3, letter c) of the Consumer Code.
- Products that are made to order or clearly customized (Article 59, letter c) of the Consumer Code). The right of withdrawal can be exercised within fourteen (14) days ("Withdrawal Period") from the day the consumer or a third party designated by the consumer, other than the carrier, physically takes possession of the product, or in the case of purchasing multiple products, from the day of delivery of the last product, or, in the case of purchasing products with multiple lots or pieces, from the day of delivery of the last lot or piece. To exercise the right of withdrawal, the customer must inform the seller, before the expiration of the Withdrawal Period, of their decision to withdraw by any explicit declaration, including the order number, order date, and the product(s) for which the right is being exercised, sent to: carbonworlditalia@gmail.com The return shipping costs are entirely the customer's responsibility, including any customs fees that may be necessary for returning the goods. Within fourteen (14) days of the withdrawal declaration, the customer must return the product, properly packaged, protected, intact, and complete with all accessories, manuals, and original labels, using the original packaging in which it was received. Upon receipt in the warehouse, CARBONWORLD ITALIA will verify the condition of the returned product and reserves the right to withhold the refund until this verification is completed. The customer expressly acknowledges that if, after the verification, the return request is refused, the purchased product will be returned to the customer, with shipping charges incurred by the customer, in cases where: • The product packaging is missing, tampered with, or damaged by the customer. • The product is missing parts, accessories, or original labels. • The product is damaged due to reasons other than transport or has preservation anomalies.
Notwithstanding the above, the customer exercising the right of withdrawal is responsible for any decrease in the value of the product resulting from handling the product beyond what is necessary to determine its nature, characteristics, and functionality. In such cases, the refunded amount will be reduced by the amount corresponding to the decrease in value. If a refund has already been processed, the seller will provide bank details for the payment owed by the customer due to the decrease in value of the product.
WARRANTY The products sold on the site have a 12-month warranty from the date of purchase. The Legal Warranty does not cover defects caused by: • Accidental events or caused by the customer. • Improper use of the product that deviates from its normal intended use or the technical documentation attached. • Handling of the product by the customer or third parties for installation purposes. We recommend that customers check product compliance upon delivery, without using it incorrectly (e.g., applying stickers improperly). We will do our best to provide all necessary information. However, if the product has a conformity defect, the customer is entitled to: a) Restore the product's conformity b) A proportional price reduction c) Resolve the contract In the case of conformity restoration, the consumer can choose between repair or replacement, as long as the chosen remedy is not impossible or does not impose disproportionate costs compared to the alternative remedy, considering all circumstances.

DISCLAIMER CARBONWORLD ITALIA disclaims any responsibility for failure to fulfill its contractual obligations due to unforeseen events or force majeure, including, but not limited to, acts of war or terrorism, strikes, national or local states of emergency, failure of transport infrastructure, power interruptions, natural disasters, etc. CARBONWORLD ITALIA will not be held responsible for any damage, loss, or costs incurred by the buyer due to the failure to execute the contract for reasons not attributable to gross negligence or willful misconduct.
INDEMNITY The user agrees to use the site and purchased products solely in accordance with these Terms and Conditions, for lawful purposes, and in no way to harm the rights of the Seller and/or third parties. The user agrees to indemnify the seller, its employees, or collaborators from any claims for damages or demands made by third parties due to acts or omissions committed by the user during interactions with the site or related to product purchases on the site.
SEVERABILITY The Terms and Conditions consist of all the clauses that make them up. If one or more provisions of these Terms and Conditions are considered invalid or declared so by law or by a jurisdictional decision, the remaining provisions will continue to be fully valid and effective.
ALTERNATIVE DISPUTE RESOLUTION The customer can use the Conciliation Procedure (ADR) provided by RisolviOnline, a service offered by the Chamber of Arbitration of the Chamber of Commerce of Milan, to resolve disputes amicably and securely with the help of a neutral and competent conciliator.
